For the purposes of the General Data Protection Regulation (“GDPR”), We are the Data Controller. 

This Privacy Notice (together with Our Terms and Conditions and Cookie policy) is meant to help You understand what data We collect, why We collect it, and what We do with it. When You share information with Us, We can make our services even better for You. For instance, We can show You more relevant search results and ads, help You connect with people or to make sharing with others quicker and easier. As You use our services, We want You to be clear how We are using information and the ways in which You can protect Your privacy. In addition, please note that We are also collecting data in connection with our recruitment process.

How is Your data collected?

Our web site collects data to operate effectively and provide You the best experiences with our services. You provide some of this data directly, such as when You create a personal account. As is described in further detail in our Cookie Policy, We get some of it by recording how You interact with our services by, for example, using technologies like cookies, and receiving error reports or usage data from software running on Your device. We also obtain data from third parties (including other companies). For example, We may supplement the data We collect by purchasing demographic data from other companies. The data We collect depends on the services and features You use.

In connection with our recruitment process, We collect information that You provide when You apply for a role. This includes information provided through an online job site, via email, in person at interviews and/or by any other method.

In particular, We process personal details such as:

  1. Personal details such as name and surname, email address, postal address, telephone number, date of birth and police conduct, where the latter is collected pursuant legal obligations we are subject to;
  2. Relevant academic and previous employment information such as qualifications, experience, employment history (including details and performance in previous positions held), skills experience that You provide to Us, as well as Your video in case You conduct Your interview using the Video Interview feature; and
  3. Any other relevant details such as willingness to relocate, applicable notice period, preferred commencement date, work eligibility, visa details, contact details of any referees (please note that it is Your responsibility to obtain consent prior to sharing with Us the referees’ personal data), photos and videos.  Furthermore, if You contact Us, We may keep a record of that correspondence and a record of Your progress through any hiring process that We may conduct.

Some data which may be considered Personal Data is collected automatically from Your device when You access our web site such as:

  1. Technical information including Internet Protocol (IP) address, login information, browser type and version, time zone setting, browser plugins and version, operating system and platform
  2. Visit information including the full Uniform Resource Locators (URL) clickstream through and from our web site (including date and time); products You viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call Our customer service number
  3. We use Workable, an external online application platform provided by Workable Software Limited, to assist with Our recruitment process. We also collect details of Your visits to Workable’s Website including, but not limited to, traffic data, location data, weblogs and other communication data, the site that referred You to Workable’s Website and the resources that You access.
  • Information We collect from other sources

Workable provides Us with the facility to link the data You provide to Us, with other publicly available information about You that You have published on the Internet – this may include sources such as LinkedIn and other social media profiles.

Workable’s technology allows Us to search various databases – some publicly available and others not, which may include Your personal data (include Your CV or Resumé), to find possible candidates to fill Our job openings. Where We find You in this way We will obtain Your personal data from these sources.

We may receive Your personal data from a third party who recommends You as a candidate for a specific job opening or for Our business more generally.

How We Process Your Information

When You create an account, You are giving Us Your Consent to collect and process Your personal data as explained in this Privacy Notice.  

Workable is only entitled to process Your personal data in accordance with Our instructions.

Where You apply for a job opening via the application function on a job site or similar online service provider (“Partner”), You should note that the relevant Partner may retain Your personal data and may also collect data from Us in respect of the progress of Your application. Any use by the Partner of Your data will be in accordance with the Partner’s Privacy Notice.

When You apply for a job opening through the Workable functionality, We rely on Your consent, which is freely given by You during the application process, to disclose Your personal data to Workable on the basis described below.

In connection with Our recruitment processes We use information held about You in the following ways:

  • to consider Your application in respect of a role for which You have applied;
  • to consider Your application in respect of other roles;
  • to communicate with You in respect of the recruitment process;
  • to enhance any information that We receive from You with information obtained from third party data providers;
  • to find appropriate candidates to fill Our job openings;
  • to help Our service providers (such as Workable and its processors and data providers) and Partners (such as the job sites through which You may have applied) improve their services.

We may use Workable’s technology to select appropriate candidates for Us to consider based on criteria expressly identified by Us, or typical in relation to the role for which You have applied. The process of finding suitable candidates is automatic, however, any decision as to who We will engage to fill the job opening will be made by Our staff.

Please note that if You are offered and accept employment with Us, the information collected during the application and recruitment process will become part of Your employment record. More information on how We process information of Our employees will be provided upon offer acceptance.

Personal Data that are automatically collected about You and/or received from third parties will be used to operate Our websites as well as to ensure that content from Our Site is presented in the most effective manner for You and Your device. To give a few examples this includes:

  • administration of Our Site and internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
  • keeping Our Site safe and secure;
  • combining Personal Data from third parties with the information We hold to personalize and enhance your experience on Our Site.

Disclosure of Your Information

For the purposes described above, Your personal data may be shared with any associated company within the Rhino Entertainment Group. We share Your personal data with Your consent or as necessary or provide any service You have requested or authorized. We also share personal data with vendors or agents working on Our behalf for the purposes described in this statement. For example, companies We’ve hired to provide customer service support or assist in protecting and securing Our systems and services may need access to personal data in order to provide those functions. In such cases, these companies must abide by Our data privacy and security requirements and are not allowed to use personal data they receive from Us for any other purpose. We may also disclose personal data as part of a corporate transaction such as a merger or sale of assets.

Where You have applied for a job opening through the Workable functionality, and where You have consented to this disclosure, We will disclose to Workable certain personal data that We hold, including but not limited to a unique identifier used by Workable to identify You, and information about Your progress through Our hiring process for the applicable job opening, as well as tangible, intangible, visual, electronic, present, or future information that We hold about You, such as Your name, contact details and other information involving analysis of data relating to You as an applicant for employment (collectively “Disposition Data”). Workable’s Privacy Notice in respect of Workable’s use of the Disposition Data is available on Workable’s website.

Where You have applied to a job opening through another service provider, We may disclose data similar to the Disposition Data defined above to such service provider. The service provider shall be the data controller of this data and shall therefore be responsible for complying with all applicable law in respect of the use of that data following its transfer by Us.

Data Storage and Data Retention

We take appropriate measures to ensure that all personal data is kept secure including security measures to prevent personal data from being accidentally lost, or used or accessed in an unauthorized way. 

Unfortunately, the transmission of information via the internet is not completely secure. Although We will do Our best to protect Your personal data, We cannot guarantee the security of Your data transmitted through any online means, therefore any transmission remains at Your own risk. We will notify You and any applicable regulator of a suspected data security breach where We are legally required to do so.

The data that We collect from You and process using Workable’s Services may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”). It may also be processed by staff operating outside the EEA who work for Us or for one of Our suppliers. By submitting Your personal data, You agree to this transfer, storing or processing.

In particular, Your data may be accessible to i) Workable’s staff in the USA or ii) may be stored by Workable’s hosting service provider on servers in the USA as well as in the EU. The USA does not have the same data protection laws as the United Kingdom and EEA. A Data Processor Agreement has been signed between Workable Software Limited and its overseas group companies, and between Workable Software Limited and each of its data processors. These data processor agreements are designed to help safeguard Your privacy rights and give You remedies in the unlikely event of a misuse of Your personal data.

We retain Your Personal Data for a period of 24 months. 

Your Rights

You can view or edit Your personal data online for many of Our services. You can also make choices about Our collection and use of Your data. How You can access or control Your personal data will depend on which services You use. Right of access

You have the right to access Your personal data and to receive Your personal data which You have provided to Us in a structured, commonly used and machine-readable format;

You have the right to ask for Your data not to be processed for the period of deciding about Your complaint in regard of challenging legality of processing of data, punctuality of data, if legitimate interest is outweighing Your rights and in situations where You want Your data to be kept for potential legal claims;

You have the right to lodge a complaint with a supervisory authority, with the mention that Our Lead Supervisory Authority is the Office of the Information and Data Protection Commissioner in Malta.
